Permanent total disability benefits (based on permanent disability of 100%) are paid for life, at the temporary disability rate. For injuries that occur on or after January 1, 2003, the benefit rate will be adjusted each year based on any increase in the state average weekly wage (SAWW).

The administrative director shall formulate the adjusted rating schedule based on empirical data and findings from the Evaluation of California's Permanent Disability Rating Schedule, Interim Report (December 2003), prepared by the RAND Institute for Civil Justice, and upon data from additional empirical studies.

PERMANENT TOTAL DISABILITY If the permanent disability is total, indemnity benefits shall be paid during the remainder of life based upon the average weekly earnings as determined under Labor Code §4453, i.e., in the same manner as temporary total disability [Labor Code §4659(b)], based on the rate in effect on the date of injury.
